These Terms serve as a legal agreement between you and SoberBud ("we," "us," or "our") governing your access and use of the Services.

If you do not agree to these Terms, please do not use the Services. Continued use of the platform signifies your consent and acknowledgment of all terms outlined here.

2. Personal and Non-Commercial Use

SoberBud provides tools, encouragement, and structured pathways to assist you on your sobriety journey. These features are designed for individual, personal use only. You agree not to use the Services for any commercial purposes unless explicitly permitted by SoberBud.

You may:

• Access and use the app for its intended recovery purposes
• Print or download portions of the content for personal use
• Share achievements and sobriety milestones through integrated tools

You may not:

• Use bots, scrapers, or automation to extract content or interfere with our systems
• Modify, reproduce, license, or sell any part of the Services without written consent
• Remove or tamper with legal or branding notices

3. Account Registration and Responsibilities

To use many features of the Services, you must create an account. You are responsible for all activity under your account, including:

• Maintaining a secure password

• Use de-identified data in aggregated reports or research

We do not claim ownership over your ideas or contributions, but by submitting them, you acknowledge that they may be used to improve the product.

5. Community Standards and Conduct

We are committed to fostering a safe and supportive environment. As a user, you agree not to:

• Harass, bully, or threaten others
• Share content that is obscene, discriminatory, or violates applicable laws
• Promote relapse, unsafe behavior, or illegal substance use
• Spam or disrupt the platform with commercial promotions

Violation of these standards may result in account suspension or removal without prior notice.

6. Third-Party Services and Integrations

Our Services may integrate with third-party platforms, including:

• Google Fit / Apple Health (for physical and health data tracking)
• Map APIs (for meeting locations)
• Notification providers (e.g., OneSignal)

We do not control the privacy or data handling practices of third-party services. Please review their terms before engaging with external platforms.

7. Intellectual Property

All intellectual property rights related to SoberBud’s app design, features, branding, and content are owned by SoberBud or its licensors. You agree not to:

• Copy or recreate any visual assets, audio, or logic flows
• Use our name, logo, or likeness without written consent
• Claim any derivative work based on SoberBud IP

Violation of these rights may be pursued under applicable intellectual property law.

8. Use of AI and Automated Technologies

SoberBud uses AI-powered tools to support user recovery, including:

• NLP to analyze journals and detect patterns
• Behavior-driven notifications for support
• Contextual messages and relapse risk nudges

These systems do not replace professional therapy or crisis intervention. You may opt out of AI-powered personalization in the app settings.

9. Disclaimers and Limitations

SoberBud is not a licensed medical provider. The content and suggestions within the Services are intended to complement—not replace—clinical support.

The Services are provided “as is” and “as available” without warranty of any kind, express or implied. SoberBud does not guarantee:

• That your use of the Services will lead to sobriety
• That the platform will be uninterrupted, timely, or error-free
• That community content will be accurate or safe

SoberBud is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services.

10. Limitation of Liability

To the fullest extent permitted by law, SoberBud shall not be liable for any indirect, incidental, punitive, or consequential damages arising from:

• Your use or inability to use the Services
• Reliance on any information provided through the platform
• Unauthorized access or alterations to your content or account

If you are dissatisfied with any part of the Services, your sole remedy is to discontinue use.

11. Indemnification

You agree to defend, indemnify, and hold harmless SoberBud and its affiliates from any claims, damages, losses, and legal expenses arising out of:

• Your breach of these Terms
• Your content submissions or actions within the app
• Any use of the Services in violation of applicable laws or the rights of others

• Deny re-registration after termination for policy violations

14. Legal Jurisdiction and Dispute Resolution

These Terms are governed by the laws of the State of Missouri, USA. Any disputes arising from these Terms shall be resolved by arbitration in Missouri unless local laws require otherwise. Each party is responsible for their own legal fees unless otherwise awarded.

• If any part is held unenforceable, the remaining sections shall remain valid
• Failure to enforce any provision shall not be considered a waiver
